BANDEL CHURCH WINS TITLE SUIT
Chinsurah (Hooghly), 25.02.2004. After 8 long years of legal procedures, finally the verdict has been pronounced: Bandel Church has been declared the indefeasible owner of the disputed Church Grounds. Today, the learned Civil Judge, Junior Division 2nd Court (in-charge), Chinsurah, Hooghly, Sri Biplab Ray, by his 40-page historic judgment dated 25.02.04, has put to rest all doubts and disputes regarding the tile and ownership of the Church Ground being Plot Nos.1723, 1724 and 1724/1737. He has declared in no uncertain terms that the title and ownership of the said land belongs to Bandel Church and none other.
The Ld. Judge has observed that the said disputed plots were recorded as "playground" (Khelarmat) because it was used as playground by the students of St. John's School, under the ownership and management of Bandel Church. Further, he was pleased to observe that the said land cannot be claimed as playground "for the use of general public" as it ha never been recorded thus, as there is no evidence at all in support of such a claim, and as the Prior Bandel Church has always been the recorded owner of the said land from the earliest to the latest land records, i.e. from the C.S. and R. S. to the L.R. records. He has made it very clear that neither the public nor any other party has any right over the said land by way of "customary easement", and that the Bandel Church alone is its owner with absolute right to use the said property for whatever purpose it deems fit. He has also observed that the said land is not a "Char land" but is the private property of Bandel Church.
Truth has triumphed and falsehood has been exposed. With this clear verdict in favour of Bandel Church, it is hoped that the opposite party will no longer continue to malign the Church authorities or to deceive the general public with false claims and baseless accusations against the Church. We do hope that people will now realize how they have been misinformed and taken for a ride by a handful of people with vested interests. We hope that the people of the locality will continue to appreciate the great contribution of this 405-year old Church towards the welfare of all, irrespective of caste or creed, particularly in the social, cultural, economic and educational fields. We hope that this clear verdict will go a long way to re-establishing the strong bond of love and understanding, of peace and harmony that always existed between the Church and all the people of the locality.
